Ok so more tests done..

Memory upgrade on servers to 78GB R420 and 96GB on R620...

somehow it increased the speeds as expected we are now getting 64Gbps aggregate troughput between servers

TL;DR ... if you have IGMP snooping enabled on switches, disable it and see if it works then. I don't have first-hand experience with SwOS, but AFAIK IGMP snooping on both SwOS and ROS is broken and breaks IPv6. At least that was the case in ROS v6 and I haven't checked it with recent ROS versions....

I would dump PPPoE, but my radius/billing software is limited on other ways to AAA dhe dhcp clients.

What is the output of /ip firewall raw print and /ip firewall raw print stats. If the requests are properly dropped, RouterOS should not be sending any ICMP packets back.

Sounds like an MTU issue, the default PPPoE server setup has an MTU of 1480. Its strange but doesnt sound like an mtu issue.. i thinks its something in the mangle , or mark-routing that its not accepting it to filter it correctly on Static LAN ips from another interface, tbh i am kind of lost now.....
